1. Acceptance of Terms

By accessing or using LocalFocal ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Platform Overview

LocalFocal is a marketplace connecting clients with photographers, videographers, hair stylists, makeup artists, and other creative professionals ("Creatives"). The Platform also features rentable shoot locations and advertising opportunities for industry partners. LocalFocal facilitates discovery and booking but is not a party to any service agreement between clients and creatives.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Fees & Payments

LocalFocal charges a platform service fee of 20% on all transactions; on bookings where 20% would fall short of $25, a $25 minimum fee applies instead. Creatives receive 80% of the agreed service price and may set their own pricing. All fees are clearly displayed before confirmation. LocalFocal processes payments securely; creatives are responsible for their own tax obligations.

5. Coupon Codes

Coupon codes may be offered by individual creatives. Codes are unique, non-transferable, and apply only to the creative who issued them. LocalFocal is not responsible for coupon value disputes between clients and creatives.

6. Bookings & Cancellations

Bookings are confirmed only when accepted by the creative. Clients and creatives are encouraged to communicate directly regarding cancellations or rescheduling. LocalFocal reserves the right to mediate disputes but is not liable for cancellation losses.

7. Dispute Resolution

All service agreements are directly between the client and the creative. LocalFocal is not a party to those agreements and is not responsible for service quality, disputes, or outcomes. Clients who experience issues with a creative should attempt to resolve them directly. LocalFocal provides a feedback and complaint mechanism for reporting serious misconduct, which may result in investigation and potential account suspension of the creative involved.

8. Platform Commission & Booking Policy

LocalFocal invests in marketing, SEO, and technology so you don't have to — bringing clients directly to you without the time and cost of running your own campaigns. In recognition of this, the following applies to all creatives listed on LocalFocal:

• A 20% platform fee applies to all bookings originated through LocalFocal. This fee is automatically calculated at the time of booking.
• All client relationships that originate on LocalFocal are platform relationships. If a client discovers you through LocalFocal, any bookings with that client — now or in the future — are subject to the platform fee.
• Completing bookings outside the platform for clients introduced through LocalFocal is a violation of these terms and may result in immediate removal from the platform.
• We encourage creatives to factor the platform fee into their pricing. For example, if your standard rate is $100, pricing at $125 still nets you your full rate while keeping the relationship transparent and compliant.

Special promotional rates (such as Founding Creative discounts) are noted separately in your account and apply only for the agreed-upon number of bookings.

9. Creative Conduct

Creatives agree to represent their services accurately, maintain professional standards, and deliver the services as described. Misrepresentation or failure to deliver may result in account suspension.

10. Locations

Location listings on LocalFocal are independently owned and operated. LocalFocal facilitates discovery of these spaces but is not responsible for the condition, availability, or safety of any listed location. Rental agreements are directly between the client and the location owner.

11. Intellectual Property

Creatives retain ownership of all work they produce. By uploading portfolio content, creatives grant LocalFocal a non-exclusive license to display that content on the Platform for marketing purposes.

12. Privacy

LocalFocal collects and processes personal data as necessary to operate the Platform. We do not sell personal information to third parties. Contact and payment information shared between users is subject to our Privacy Policy.

13. Limitation of Liability

LocalFocal is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform, including disputes between clients and creatives, service quality issues, or technical outages.

14. Modifications

LocalFocal reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
