By accessing and using the LocalFocal platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on LocalFocal for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials.
• Use the materials for any commercial purpose or for any public display.
• Attempt to reverse engineer, disassemble, or decompile any software.
• Remove any copyright or other proprietary notations from the materials.
• Transfer the materials to another person or "mirror" the materials on any other server.
• Use automated tools to access the platform without authorization.

3. Disclaimer

The materials on LocalFocal are provided on an 'as is' basis. LocalFocal makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall LocalFocal or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on LocalFocal, even if LocalFocal or a LocalFocal authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on LocalFocal could include technical, typographical, or photographic errors. LocalFocal does not warrant that any of the materials on the platform are accurate, complete, or current. LocalFocal may make changes to the materials contained on the platform at any time without notice.

6. Materials Provided by Users

You are responsible for all content you upload, create, or submit to LocalFocal, including photos, videos, descriptions, and pricing information. You represent and warrant that:

• You own or have the right to use all content you submit.
• Your content does not infringe on any third-party rights.
• Your content complies with all applicable laws and this agreement.
• Your content is accurate and not misleading.

LocalFocal reserves the right to remove any content that violates these terms or applicable law.

7. User Conduct

You agree not to:

• Engage in abusive, harassing, or discriminatory behavior.
• Post false or misleading information.
• Attempt to manipulate pricing, ratings, or reviews.
• Conduct transactions outside the platform to avoid fees.
• Violate any applicable laws or regulations.
• Interfere with or disrupt the platform or its services.

8. Payment Terms

All transactions on LocalFocal are processed through Stripe. By making a purchase, you agree to Stripe's payment terms. LocalFocal charges a platform fee on each transaction as specified in our pricing structure. You will receive detailed information about platform fees and pricing when you list your service and will have the opportunity to agree to these terms before proceeding.

9. Dispute Resolution

In the event of a dispute between a client and a creative, both parties agree to first attempt to resolve the matter directly. If resolution cannot be reached, either party may contact LocalFocal for mediation. LocalFocal's decision is final and binding.

10. Account Termination

LocalFocal reserves the right to terminate or suspend any account that violates these terms or engages in fraudulent or harmful conduct. Termination may result in the loss of access to the platform and forfeiture of any pending balances.

11. Intellectual Property Rights

LocalFocal and its content (excluding user-submitted content) are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or transmit any content without prior written permission.

12. Limitation of Liability

LocalFocal is not responsible for any disputes between users, quality of services provided, or non-delivery of services. Users are solely responsible for verifying the credentials and quality of creatives before booking.

13. Modifications to Terms

LocalFocal may modify these Terms of Service at any time. Continued use of the platform after modifications constitutes acceptance of the updated terms.
